A consultation cancelled or rescheduled with less than 24 hours' notice may be treated as used.
A missed appointment without notice is treated as a completed/used session and is not refundable.
27. Consultations included in 1:1 programs
Program consultations and check-ins should be used within the agreed program period.
They may be rescheduled with at least 24 hours' notice.
Sessions missed or cancelled with less than 24 hours' notice may be forfeited.
Unused sessions do not automatically extend a program unless agreed in writing.
28. General refund policy
Except where mandatory consumer law provides otherwise, fees paid for:
-
consultations
-
personalised programs
-
workshops
-
webinars
-
courses
-
digital products
-
educational services
are non-refundable once the relevant service has begun or personalised work has commenced.
Personalised work may include reviewing your intake information, reviewing health history, preparing recommendations, preparing protocols, researching suitable products or herbs, providing consultation time, creating individualised resources or providing other work specifically for you.
29. EU right of withdrawal for distance contracts
Where applicable, consumers purchasing services online or at a distance may have a statutory 14-day right of withdrawal beginning from the date the contract is concluded. Cyprus consumer guidance reflects this rule for distance service contracts.
However, this does not mean that services already performed must be provided free of charge.
Where you expressly request that Marogya Ayurveda begins providing a paid service before the end of the applicable withdrawal period, you agree that the service may begin immediately.
If you subsequently exercise a statutory withdrawal right before the service has been fully performed, you may be required to pay an amount proportionate to the services already provided up to the time of withdrawal.
This amount will be calculated in accordance with applicable consumer law, taking into account the total agreed price and the extent of the service already provided. EU consumer law expressly provides for proportionate payment in these circumstances.
Where a service has been fully performed, and performance began with your prior express consent together with your acknowledgement that you would lose your right of withdrawal once the service was fully performed, the statutory right of withdrawal may no longer apply.
Nothing in this policy removes any consumer right which cannot legally be excluded.
30. Starting services during the withdrawal period
Where a consultation, program or other service is due to begin within 14 days of purchase, you may be asked to confirm:
“I expressly request that Marogya Ayurveda begins providing the service before the end of the applicable 14-day withdrawal period. I understand that if I withdraw after the service has begun, I may be required to pay for the services already provided. I acknowledge that once the service has been fully performed, I may lose my statutory right of withdrawal.”
This consent should be given separately at booking, checkout, application acceptance or invoice acceptance where relevant.
31. Programs involving ongoing personalised work
For multi-week or multi-month personalised programs, withdrawal during an applicable statutory withdrawal period does not automatically entitle the client to reimbursement for work already performed.
Where the client expressly requested immediate commencement, services already delivered may be deducted on a proportionate basis in accordance with applicable law.
After any applicable statutory withdrawal period has expired, program fees are non-refundable except where required by law.
32. Workshops and live events
If you do not attend a live workshop, consultation, webinar or event that proceeds as scheduled, no refund is ordinarily provided.
If Marogya Ayurveda cancels a paid event and is unable to provide an appropriate alternative, we may provide a rescheduled session, credit or refund as appropriate.
33. Digital content
Digital products, downloadable resources, recordings and other digital content may be subject to specific consumer rules.
Where immediate access is supplied before the statutory withdrawal period has ended, additional express consent and acknowledgement may be requested where required by law.
